1. The program

THE SHADE is the creator program for DARK MODE (Good Hour Inc., “DARK MODE”, “we”). By signing, you (“you”, the creator) join as an affiliate. We send you one free Activation Kit and a personal link through Shopify Collabs.

2. Commission

• You earn commission on eligible orders placed through your link within 90 days of a click, including the first order of a new subscription.
• Tier 1: 10%. Tier 2: 12% once your link has driven 10 sales. Tier 3: 15% at 50 sales.
• Commission is calculated on the order subtotal after discounts, excluding shipping and taxes, and is paid through Shopify Collabs on its payout schedule.
• Orders that are refunded, cancelled, fraudulent or placed by you for yourself don’t earn commission.

3. Your content

• You’re not required to make content or deliver assets. There’s no posting schedule and no content quota.
• THE SHADE is for active creators. If we haven’t received any DARK MODE content from you within 30 days of your kit being delivered (a post that tags @darkmodematcha, or a video sent to us), we’ll remove you from the program. It’s how we keep the program accountable without asking you to work for free product.
• When you do post, it’s your voice and your style.

4. Disclosure

Because you receive free product and earn commission, every post about DARK MODE must clearly disclose the relationship: turn on the platform’s paid partnership or branded content label and include #ad in the caption. This is required by the FTC.

5. What you can and can’t say

• Talk about how it tastes, how fast it is and how it fits your day.
• Don’t make health, medical, weight-loss or disease claims, and don’t share pricing or offers that aren’t on our site.
• Keep your content legal, honest and free of hate, harassment or anything that would embarrass either of us.

6. Using your posts

• You keep ownership of your content. You give DARK MODE a non-exclusive right to reshare your DARK MODE posts on our channels and website, with credit to you, for 12 months from posting.
• 3 months of paid usage is included. If we decide to scale one of your organic DARK MODE videos as a partnership ad (Instagram partnership ads or TikTok Spark Ads), joining THE SHADE gives us the right to run it as a paid ad for 3 months from the day that ad first runs, with no extra fee. You’ll grant the ad access inside the platform when we ask.
• Paid usage beyond 3 months, or any other ad use, is agreed with you separately.

7. Our relationship

You’re an independent creator, not an employee or agent of DARK MODE, and you’re responsible for your own taxes. Shopify Collabs handles payout details and tax forms.

8. Leaving the program

Either of us can end this at any time by email. Commission already earned on valid orders is still paid. We may remove creators who break this agreement, or who haven’t shared any DARK MODE content within 30 days of kit delivery (see section 3). A partnership ad already running under section 6 can finish its 3-month run.

9. Eligibility

You must be 18 or older with a US shipping address. One Activation Kit per creator.
